1. Overview and Acceptance

This website is operated by Kimono Avenue LLC (Kimono Avenue Godo Kaisha), based in Osaka, Japan. Throughout these Terms of Service, “Kimono Avenue,” “we,” “us,” and “our” refer to Kimono Avenue LLC. These Terms govern your access to and use of kimonoave.com, including any purchases made through the website. By accessing the website or placing an order, you agree to these Terms and the policies referenced in them. If you do not agree, please do not use the website.

2. Eligibility and Store Use

You must be legally capable of entering into a binding contract in your country or have the permission of a parent or legal guardian. You may use our website only for lawful personal or business purposes and in accordance with these Terms. You are responsible for maintaining the accuracy and confidentiality of any account information you provide.

3. Products and Product Information

We make reasonable efforts to display product descriptions, dimensions, materials, colors, and images as accurately as possible. However, colors may appear differently depending on your screen, device, and display settings.

Some products use natural materials, traditional designs, handcrafted processes, or made-to-order printing. Minor variations in color, texture, pattern placement, finish, or dimensions may occur and are not considered defects when they fall within reasonable production tolerances. This does not limit your rights if a product is faulty, damaged, or materially different from its description.

4. Prices, Currency and Taxes

Product prices may change without notice. The price and currency displayed at checkout apply to your order. Currency conversions displayed on the website may be based on current exchange rates and can change over time.

VAT, import duties, local taxes, or carrier handling fees may apply depending on the destination and product. Unless collected at checkout, these charges are the customer’s responsibility. Further information is available in our Shipping Policy.

5. Orders and Contract Formation

By placing an order, you confirm that the information provided is complete and accurate and that you are authorized to use the selected payment method. An order is accepted when we send you an order confirmation email.

We may refuse or cancel an order before dispatch for reasons including payment failure, suspected fraud, pricing or product information errors, product unavailability, quantity restrictions, delivery limitations, sanctions compliance, or suspected misuse of the website. We will provide a full refund if we cancel an order after payment has been received.

Because fulfillment or production may begin shortly after an order is confirmed, customer-requested cancellations may not always be possible. Any mandatory cancellation rights under applicable law remain unaffected.

6. Payment and Billing Information

Available payment methods are displayed at checkout and may be provided by Shopify or other third-party payment processors. You agree to provide current, complete, and accurate billing and payment information. We may delay or cancel an order if payment cannot be authorized or if additional verification is reasonably required to prevent fraud.

7. Promotions and Discounts

Promotions and discounts are subject to the conditions displayed on the website at the time of purchase. The offer “Buy 3 or more items and save 10% — applied automatically at checkout” applies when three or more eligible items are included in a single order.

Automatic discounts are calculated at checkout. Whether a promotion can be combined with another discount will be shown at checkout. Promotions may be changed or ended before an order is placed but will not affect an order that has already been confirmed.

8. Shipping and Delivery

Orders are processed and dispatched in accordance with our Shipping Policy. Delivery dates are estimates and may be affected by customs clearance, weather, carrier delays, or other circumstances outside our reasonable control.

You are responsible for providing a complete and accurate delivery address. Additional costs caused by an incorrect or incomplete address, refusal of delivery, or failure to collect a package may be charged to you. Responsibility for the goods passes to you when the order is delivered to you or a person designated by you, subject to applicable law.

9. Returns, Refunds and Damaged Items

Returns, exchanges, refunds, order issues, and products damaged in transit are handled according to our Return and Refund Policy. Some made-to-order products may have different return conditions, as stated in that policy and on the relevant product page. Nothing in these Terms limits any mandatory consumer rights that apply to you.

10. Personal Information

Our collection, use, storage, and disclosure of personal information are governed by our Privacy Policy. Payment information may also be processed by Shopify and the payment provider selected at checkout under their respective privacy policies.

11. Intellectual Property

The Kimono Avenue name, logos, brand assets, product photography, original text, product designs, digital restorations, layouts, graphics, videos, and other original website content are owned by or licensed to Kimono Avenue and are protected by applicable intellectual property laws. You may not reproduce, distribute, modify, sell, or commercially exploit this content without prior written permission.

Some products and content may incorporate Japanese artworks or source materials that are in the public domain. The public-domain status of a source artwork does not grant permission to copy Kimono Avenue’s product photography, scans, digital processing, original adaptations, written content, layouts, branding, or other independently protected materials.

12. Reviews, Feedback and Customer Content

If you submit a review, photograph, video, comment, suggestion, or other content to us, you confirm that the content is truthful, that you own it or have permission to submit it, and that it does not violate the rights of another person.

You retain ownership of your content. By submitting it to us, you grant Kimono Avenue a non-exclusive, worldwide, royalty-free license to use, reproduce, publish, translate, format, and display it in connection with our website, products, social media, advertising, and other brand communications. We may shorten or format customer content for presentation purposes but will not intentionally change its meaning.

We may refuse, hide, or remove content that is unlawful, abusive, misleading, unrelated, fraudulent, infringes another person’s rights, contains personal information, or violates these Terms. We are not required to publish every submission.

13. Third-Party Services and Links

Our website may contain links to or use services provided by third parties, including Shopify, payment providers, delivery carriers, review platforms, and social media services. We are not responsible for the content, availability, security, or practices of independent third-party websites and services. Your use of those services may be subject to their own terms and policies.

14. Prohibited Uses

You may not use the website or its content for any unlawful, fraudulent, abusive, misleading, defamatory, discriminatory, infringing, or harmful purpose. You may not upload malicious code, interfere with website security, attempt unauthorized access, collect another person’s personal information, impersonate another person, submit false information, engage in fraudulent transactions, or use automated systems to scrape or exploit the website without permission. We may restrict or terminate access where we reasonably believe these Terms have been violated.

15. Errors, Availability and Service Changes

We do not guarantee that the website will always be uninterrupted, secure, or error-free. The website and its general informational content are provided on an “as available” basis. This disclaimer does not apply to specific commitments made about products you purchase or to rights that cannot legally be excluded.

To the fullest extent permitted by law, Kimono Avenue will not be liable for indirect, incidental, special, or consequential losses arising from the use or inability to use the website. Where liability may lawfully be limited, our total liability relating to an order will not exceed the amount paid for that order.

Nothing in these Terms excludes or limits liability for fraud, willful misconduct, gross negligence, death or personal injury caused by negligence, or any liability or consumer right that cannot be excluded or limited under applicable law.

17. Indemnification

To the extent permitted by law, you agree to compensate Kimono Avenue for reasonable losses, liabilities, and expenses arising directly from your unlawful use of the website, your infringement of another person’s rights, or your material breach of these Terms. This section does not apply to ordinary consumer complaints or claims relating to products purchased from us.

18. Force Majeure

We are not responsible for delays or failure to perform caused by events beyond our reasonable control, including natural disasters, severe weather, war, civil disturbance, government action, customs disruption, carrier interruption, labor disputes, epidemics, power failures, or telecommunications failures. We will take reasonable steps to reduce the effect of such events and resume performance when reasonably possible. Your mandatory rights remain unaffected.

19. Severability, Waiver and Entire Agreement

If any provision of these Terms is found to be unlawful, invalid, or unenforceable, that provision will be limited or removed only to the extent necessary, and the remaining provisions will continue in effect. A delay or failure by us to enforce a provision does not waive our right to enforce it later. These Terms and the policies referenced in them form the entire agreement between you and Kimono Avenue concerning your use of the website and purchases from us.

20. Governing Law and Jurisdiction

These Terms and any contract between you and Kimono Avenue are governed by the laws of Japan, without regard to conflict-of-law principles. The Osaka District Court will have exclusive jurisdiction as the court of first instance, except where applicable consumer law gives you the right to bring a claim in another court. If you are a consumer, this choice of law and jurisdiction does not deprive you of mandatory protections or legal rights available under the laws of your country of habitual residence.

21. Changes to These Terms

We may update these Terms by posting a revised version on this page and changing the “Last updated” date. Changes apply from the date they are published and do not retroactively alter orders already confirmed, unless required by law. Your continued use of the website after an update constitutes acceptance of the revised Terms.
